Kirsten Gillibrand (D-N.Y.), which did not get a vote, would have treated waste at the West Valley Demonstration Project in New York as defense-related only under the Nuclear Waste Policy Act of 1982, meaning the material would not be eligible for disposal at the Energy Department Waste Isolation Pilot Plant in New Mexico.
