Petitioners in a case that would force the Nuclear Regulatory Commission to complete the Yucca Mountain licensing process Friday urged the court to lift a hold on the case that has been in place since last August. The U.S. Court of Appeals for the D.C. Circuit placed the petition in abeyance until Dec. 14 to give Congress a chance to weigh in during the appropriations process. In a motion to lift abeyance Friday petitioners including the National Association of Regulatory Utility Commissioners and South Carolina and Washington noted that so far Congress has not taken any action prohibiting licensing of the repository. “This case, which focuses on unreasonably delayed agency action, should not be delayed any longer,” the filing states.
