In about a month, a New Jersey court will decide whether to force Holtec International to turn over additional information sought by a former finance chief who has sued the company for wrongful termination.
Lawyers for Kevin O’Rourke, the ex-chief financial officer who sued in June, filed a motion with the Superior Court of New Jersey in Camden County that would, if granted, force Holtec, Jupiter, Fla., to produce documents that O’Rourke’s camp said should have been turned over to the plaintiffs months ago.
After O’Rourke filed his motion, Holtec “provided additional documents, but still refused to provide a significant amount of information and documents requested,” according to a letter the former finance chief’s lawyers filed with the court last week.
The court was to consider O’Rourke’s motion on March 28, according to a Friday filing. O’Rourke’s lawyers wanted the motion to come before a judge by Friday, but Holtec’s camp had a “scheduling conflict” and asked for a delay, which the judge granted.
The parties are now trying to “resolve the dispute among themselves,” according to a letter Holtec’s lawyers filed with the court last week.
In his suit, O’Rourke claims that Holtec fired him because he refused to endorse a document he characterized as a bogus investor prospectus. According to O’Rourke, the document greatly overvalued multiple Holtec business lines, including its proposed interim spent-fuel storage facility in New Mexico.
The prospectus was meant for Hyundai Engineering and Construction of South Korea, which in May announced it had entered into a partnership with Holtec.
Holtec has said O’Rourke’s allegations are “without merit.”
